Hicks Arrested Again
The Yancey County Sheriff's Office and the Burnsville Police Department have arrested Charles Levell Hicks, 38, 23 Lester Lane in Burnsville and charged him with the following:
Sell and Deliver a Schedule II controlled Substance (Morphine)
Possession with intent to Manufacture, Sell or Deliver a Schedule II controlled substance (Morphine)
Possession of a Schedule II controlled substance (Morphine)
Sell and Deliver a Schedule VI controlled substance(Marijuana)
Possession with intent to Manufacture, Sell or Deliver a Schedule VI controlled substance (Marijuana)
Possession of a Schedule VI controlled substance (Marijuana)
Two Counts of Maintaining a Dwelling place for the purpose of selling controlled substances.
Sell and Deliver a Controlled Substance within 1000ft of a Park
Aid and Abet the sell and delivery of a schedule VI controlled substance (Marijuana)
Delivery of a Schedule VI controlled substance (Marijuana)
Hicks was out on bond at the time of the arrest from previous drug charges on which he is still awaiting a trial date. At the time of the arrest officers served a search warrant of Hicks' residence and seized an additional 50 grams of Marijuana. Sheriff Gary Banks stated "I am pleased with the work the two departments have done on this case due to both the proximity of the youth league recreation parks and day care facilities as well as the fact that this individual is of constant concern to the community due to his continued illegal actions." Hicks is currently held under a $200,000 bond at the Yancey County Jail and has a court date of 1/20/2012.
Three Arrested as part of Drug Operation
The Yancey County Sheriff's Office and the Burnsville Police Department have arrested three individuals as a part of the continuing drug operation between the two departments.
Christopher Lee Elliot, 25, of Satinwood Drive in Burnsville was arrested and charged with the following:
Trafficking in opium or heroin,
Felony Possession of a Schedule II drug,
Possession with intent to sell
Manufacture or deliver a Schedule II drug,
Maintaining a Vehicle\ Dwelling place for the sale of controlled substances,
Simple Possession of Schedule II,
Possession of Drug Paraphernalia
James Ray Elliot, 23, of Satinwood Drive in Burnsville was arrested and charged with the following:
Trafficking in opium or heroin,
Felony Possession of a Schedule II drug,
Possession with intent to sell
Manufacture or deliver a Schedule II drug,
Maintaining a Vehicle\ Dwelling place for the sale of controlled substances,
Simple Possession of Schedule II,
Simple Possession of Schedule IV
William Daniel Elliot, 67, of Satinwood Drive was arrested and charged with the following:
Trafficking in opium or heroin,
Felony Possession of a Schedule II drug,
Possession with intent to sell
Manufacture or deliver a Schedule II drug,
Maintaining a Vehicle\ Dwelling place for the sale of controlled substances,
Simple Possession of Schedule II,
Possession of Drug Paraphernalia
Al three men made bond and have a September 13 court date. These individuals were arrested with 112 Oxycodone pills in their possession which they were selling illegally. Sheriff Gary Banks stated these individuals were of great concern to the people of the community they reside in and he is pleased to see them brought to justice.
Ongoing Drug Investigations Between the Yancey County Sheriffs Office and Burnsville Police Department Result in More Arrests
On July 1, 2011 Teresa Jane McClellan Morgan of Cabin Hill Road in Spruce Pine, NC was arrested in the Micaville area of Yancey County for multiple drug charges. Morgan was charged with Sell and Deliver Schedule IV Controlled Substance, Possession with Intent to Manufacture, Sell, and Deliver Schedule IV Controlled Substance, Maintaining a Vehicle to Sell Controlled Substance, and Simple Possession of Schedule IV Controlled Substance. Morgan was taken into custody and taken before Magistrate Terry M. Hall where she was placed under a $7,500.00 secured bond. In addition to these current charges, Morgan has several pending drug charges where true bills of indictment were issued on May 31, 2011 by the Yancey County Grand Jury.
On June 11, 2011 Christopher Dale Robinson of Fairhaven Drive in Burnsville, NC was arrested after on multiple drug charges. Robinson was charged with Level Two Trafficking in Opium, Possession with Intent to Manufacture, Sell, and Deliver Schedule II Controlled Substance, Simple Possession of Schedule II Controlled Substance, and Possession of Drug Paraphernalia. Robinson was taken into custody and placed under a $34,000.00 Secured Bond.
On June 13, 2011 Darrell Wayne Carroll of Plum Branch Road in Burnsville, NC was arrested on multiple drug charges. Carroll was charged with Level Two Trafficking in Opium, Possession with Intent to Manufacture, Sell, and Deliver Schedule II Controlled Substance, Maintaining a Vehicle to Sell Controlled Substance, Simple Possession of Schedule II Controlled Substance, and Possession of Drug Paraphernalia. Carroll was taken into custody and placed under a $36,000.00 Secured Bond.
On June 9, 2011 Darrell Wayne Carroll of Plum Branch Road in Burnsville, NC was also charged on June 9, 2011 with Possession of a Firearm by a Felon, Simple Possession of Schedule IV Controlled Substance, and Possession of Drug Paraphernalia and placed under a $8000.00 Secured Bond.
On June 22, 2011 Johnny D. Cooper of Letterman Road in Green Mountain, NC was arrested and charged with Manufacture of Schedule VI Controlled Substance. These charges resulted after deputies arrived at Cooper's residence on an unrelated matter and after speaking with Cooper, deputies located three Marijuana Plants growing inside of the residence. Cooper was taken into custody and placed under a $2000.00 Bond.
Drug Enforcement Operation leads to Multiple Arrests
The Yancey County Sheriff's Office and the Burnsville Police Department have conducted a month and a half long drug
operation which has resulted in numerous arrests on Tuesday. Sheriff Gary Banks stated that there were 256 charges
issued for 24 different individuals on a variety of drug and firearm related charges. There were 32 charges for
trafficking in controlled substances, 12 charges related to the sale of Methamphetamine and various other charges
connected to the sale of prescription medication. Banks stated this operation is a continuation of the ongoing efforts
between the two departments to deal with the growing problem of drug abuse both in the Town of Burnsville and Yancey
County as a whole.
This investigation has revealed that several of these individuals had been selling quantities of prescription
medication in excess more than 1000 pills per month. Information provided to the investigators revealed that these
medications came from various sources and many came from other states. Chief Buchanan stated he is encouraged by the
ability of the two departments to work together for a common goal and he would like to thank the concerned citizens
who have assisted each department with helpful information. This operation was also assisted by the North Carolina
Department of Revenue in order to assess drug taxes and to levy on money and property to satisfy the money owed by
those that had profited from the drug trade.
Breaking and Entering at Sav-Mor
On April 20th, 2011 Officer Gerald Barnett received a call from Sav-Mor Grocery that they were missing several cartons
of cigarettes and several cases of beer. Upon arrival Officer Barnett watched the video surveillance from the store's
surveillance system and identified the suspect as Antonio Camacho -Gomez . Officer Barnett then contacted Lt. Detective
Randall Shuford and advised him of the situation. As the investigation progressed throughout the day Sheriff's deputies
John Robinson and Brian Shuford became involved in the search for the suspect and the missing items. Several of the
items missing from the store were located concealed behind the store in the wooded area behind the shopping center.
After a tip received by Lt. Randall Shuford, deputies located the subject at a residence close to the store and he was
arrested without incident. The suspect still had in this possession several of the items matching a description of the
items taken. Antonio Camacho-Gomez, 27 of Wheeler Trailer Park, Burnsville was taken before a Yancey County Magistrate
and charged with Felony breaking entering and larceny and Possession of stolen property. Suspect was given a $9000.00
secured bond and has a April 26th 2011 court date.
Arrests Involving Tax Fraud
On March 02, 2011 Lt. Detective Randall Shuford with the Burnsville Police Department took three individuals into
custody for fraud related charges. Jason Palenko, 37, of Spruce Pine, Angie Noblitt, 26, of Burnsville and Michelle
Hensley, 33, of Burnsville where all arrested due to the results of an investigation that revealed that Palenko and
Noblitt took the social security cards of Michelle Hensley's children and went to a local tax filing company and filed
their 2010 taxes using one each of Hensley's children's information claiming that Hensley's children was their own on
their taxes for a child tax credit. The investigation also revealed that Hensley was not planning on filing 2010 taxes
so she worked out an agreement with Palenko and Noblitt allowing them to use her children's information in return Hensley
would receive part of the money Palenko and Noblitt received back from the Internal Revenue Service and North Carolina
Department of Revenue. Palenko and Noblitt were charged two counts each of Felony Obtaining Property by False Pretenses
and were given a $5000.00 secured bond each. Hensley was charged with two count of Aid & Abet Obtaining Property by
False Pretenses
and was given a $6000.00 secured bond. All three were given a March 2011 court date in Yancey County District Court.
More Drug Arrests
On February 13, 2011 Officer Michael Capellupo with the Burnsville Police Department conducted a traffic stop that resulted
in several drug violations against the vehicle's owner/operator. Missy Paulette Hicks, 30, of Lester Lane, Burnsville
was arrested and charged with 1 count of Felony maintaining a vehicle for the purpose of keeping and selling controlled
substances, 1 count of possession with the intent to sell and deliver a schedule II controlled substance (Endocet),1
count of possession with the intent to sell and deliver a schedule II controlled substance (Oxycodone),1 count of
possession with the intent to sell and deliver a schedule II controlled substance (Methadone), 1 count of possession
with the intent to sell and deliver a schedule II controlled substance (Hydrocodone), 1 count of possession with the
intent to sell and deliver a schedule V controlled substance (Lyrica), 1 count of possession of drug paraphernalia and
Hicks was also charged with driving with no operator's license. Hicks was taken before a Yancey County Magistrate and
was given a $16,500.00 secured bond and has a court date in Yancey County District Court on February 22, 2011.
Hicks Arrested
Charles Levell Hicks, B/M, 37, of Lester Lane, Burnsville was arrested and served with warrants for the following drug
offenses: 3 counts of Sell and Deliver Marijuana a Schedule VI controlled substance, 3 counts of Possession with Intent
Manufacture and Sell and Deliver Marijuana, 3 counts of Maintaining a Dwelling to Sell and Deliver a Controlled Substance,
1 count of Felony Possession of Marijuana and 2 counts of Simple Possession of Marijuana. Hicks was taken before a Yancey
County Magistrate and was given a $24,000.00 secured bond and is scheduled to appear in Yancey County District Court on
February 22,2011.
Byrd Drug Arrest
Kristin Lea Byrd ,W/F, 35 , of 21 Woodland Drive, Burnsville was arrested and served with the following
warrants for drug offenses: 4 counts of Sell and Deliver a Schedule II Controlled Substance (3 counts of selling Oxycodone
and 1 count selling Methadone) 4 counts of Possession with Intent to Manufacture Sell And Deliver a Schedule II Controlled
Substance, 1 Count of Maintaining a Vehicle to Sell and Deliver a Schedule II controlled substance, 3 counts of
Maintaining a Dwelling to Sell And Deliver a Schedule II Controlled Substance and 4 counts of Possession of a Schedule II
Controlled Substance. Byrd Was taken before a Yancey County Magistrate and was given a $53,000.00 secured bond and is
scheduled to appear in Yancey County District Court on February 22, 2011.
Woody Arrest
Jerry Lee Woody, W/M, 43 , of Harmony Ridge Road, Burnsville was arrested and served with the following warrants for
drug offenses: 1 count of Aid and Abet Sell and Deliver a Schedule II Controlled Substance (Methadone) , 1 count of Aid
and Abet Possession with the Intent to Manufacture Sell and Deliver a Schedule II Controlled Substance and 1 count of
Possession of a Schedule II Controlled Substance. Woody was taken before a Yancey County Magistrate and given a $11,000.00
secured bond and is scheduled to appear in Yancey County District Court on February 22,2011.
Deyton Arrested
Jamie Smith Deyton, 31, of Oak Hill Drive, Burnsville was taken into custody on Jan 27th, 2011
and served with multiple warrants that had resulted from a drug investigation conducted by the Burnsville Police
Department. Deyton was charged with the following charges, 2 counts of sell and delivery of a schedule II controlled
substance, 1 count of sell and delivery of a schedule IV controlled substance, 2 counts of possession with intent to
manufacture sell and deliver a schedule II controlled substance, 1 count of possession with intent to manufacture sell
and deliver a schedule IV controlled substance, 3 counts of maintaining a dwelling to sell a controlled substance,
2 counts of possession of a schedule II controlled substance and 1 count of possession of a schedule IV controlled
substance. Deyton was taken before a Yancey County Magistrate and was given a secured bond of $31,500.00 and has a
court date of February 08, 2011.
Burnsville Drug Arrest
Shayna Brooke Turner, 23, of Bee Branch Road, Burnsville was arrested on Jan 31st, 2011 and served with
the following warrants for her arrest. 3 counts of sell and delivery of a counterfeit controlled substance and 3 counts
of possession with intent to manufacture sell and deliver a counterfeit controlled substance. This was a result of a
investigation conducted by the Burnsville Police Department. Turner was also served with a order for arrest from where
she failed to appear in Yancey County Superior Court on January 31st, 2011. Turner was taken before a Yancey County
Magistrate and was given a $28,000.00
secured bond and has a court date in Yancey County District Court on February 08, 2011.
Officers Arrest Grocery Thief
Raymond Watson Hellard III, 39 of Rock Creek Road, Burnsville NC, was arrested by
Officers with the Burnsville Police Department on October 17th, 2010. According to Lt. Detective Randall
Shuford reports had been made to the Police Department that a man living on Rock Creek Road in the county
was stealing items, mostly meats, from Ingles Supermarket and then going throughout the community of South Toe
trying to sell these items. It was also reported that this individual was taking orders from certain
individuals and stealing the items these individuals particularly wanted and making home deliveries of these
items. Lt Detective Randall Shuford , Officer Jason Chandler and Officer Brandon Mitchell conducted a
surveillance operation on this individual and on the evening of
October 17th, 2010 he was observed by the officers entering Ingles Supermarket in Burnsville. The officers
where able to watch Hellard go throughout the store and load a shopping cart completely full of items. Then
when he was done loading the shopping cart Hellard walked over to the west end entrance to the store looked
around a bit then pushed the shopping cart full of items out of the store without paying for them. The
officers approached Hellard in the parking area and arrested him for stealing the items. The officers
had a Ingles employee ring up a total amount of goods stolen the total came up to $484.04. Officers took
Hellard to the Yancey County Magistrates Office to be processed. Hellard told the officers his full legal name was
Ralph Shelton Hellard. Upon running Hellard's name through the warrants check system it was
discovered that Hellard had given a false name to the officers. Hellard's real name was determined to be
Raymond Watson Hellard III. It was then learned that Hellard had been using this name for a
couple of years and had charges in the court system under his alias name. It was also learned that Hellard was a wanted person from Davie County North Carolina for
failure to appear on multiple counts of larceny of a firearm. The name Hellard had been giving was actually
his brother's name to avoid prosecution of charges against him. Locally Hellard was charged with Identity
Theft, Larceny of Goods and Possession of Stolen Property. Hellard was also served with the Davie County
warrant and will be transported back there at some point to face the charges against him there. Hellard
Remains in the Yancey County Jail under a $90,000 secured bond for all charges. Hellard's has a court date
in Yancey County of October 29th, 2010. Lt. Detective Shuford stated that the investigation continues into
the matter of Hellard stealing from other stores in this county and other counties as well and the fact of
some individuals buying the items Hellard was stealing while knowing them to be stolen.
Hinds Drug Arrest
On August 05, 2010, Daniel Joseph Hinds, 29, of the Green Mountain
Community was arrested by Officer Michael Capellupo of the Burnsville
Police Department. Hinds was taken before a Yancey County Magistrate
and charged with Felony Delivery of a Schedule II Controlled Substance
liquid Methadone. It is alleged that Hinds met with a female in a
local business parking lot and provided her with a dose of liquid
methadone. Hinds was given a $2000.00 secured bond and has a August
24, 2010 court date in Yancey County District Court.
Teal Arrested
Jonah David Teal,25, of West Ridge Road, Burnsville has been arrested by Sergeant Gerald
Barnett of the Burnsville Police Department on July 28th 2010. Felony warrants for the following charges
were served on Teal, Forgery of Instrument, Uttering a Forged Instrument and Obtaining Property by False
Pretense. A investigation conducted by Officer Jonathon Bennett revealed that on June 28th 2010 Teal
presented a check to Burnsville Gas INC. for the amount of $250.00. The check was on another persons
closed checking account that Teal is alleged to have filled out payable to himself and presented to
Burnsville Gas for payment. Teal was taken before a Yancey County Magistrate and placed under a $9000.00
secured bond and has a August 24th, 2010 court date. Teal has posted bond and awaiting trial.
Williams Drug Arrest
On July 1st, 2010 Brandon Joseph Williams,28,of Coco Lane,Burnsville,NC was arrested and served
with arrest warrants by Sergeant Gerald Barnett of the Burnsville Police Department. The arrest was for the following offenses:
sell and deliver a schedule II controlled substance (oxycodone), possession with intent to sell and deliver a controlled
substance (oxycodone)and possession of a schedule II controlled substance (oxycodone). This arrest was the result by an
investigation conducted by Lt. Detective Randall Shuford. Williams was taken before a Yancey County Magistrate and given
a $6500.00 secured bond.Williams is scheduled to appear in Yancey County District Court on July 7th, 2010.
Austin Arrested on Drug Charges
The Burnsville Police Department has arrested Brittany Anne Austin, 21 of 5 Evans Street
and charged her with several drug violations. Austin was charged with Sell and Deliver of Oxycodone, Possession
with intent to sell and deliver Oxycodone, and simple possession of Oxycodone. Sgt. Brandon Buchanan and patrol
officers Jonathan Casteel and Brandon Mitchell assisted Lt Detective Randall Shuford in serving a search warrant
of Austin's residence and serve the warrants that had been issued. Austin was released after posting bond and has a court date of 6/18/2010.
Peterson Arrested Again
The Burnsville Police Department has arrested Christopher Lee Peterson, 24 of 3 Evans Street, and charged him
with several drug violations. Peterson was charged with Possession with Intent to Manufacture Sell or Deliver a Schedule II controlled
substance, Maintaining a Dwelling Place for the purpose of Selling a Controlled Substance, Aid and Abet the Sell of a Schedule II controlled
substance and Simple possession of a Schedule II controlled substance. Peterson was out on bond from previous trafficking charges when
Sgt. Brandon Buchanan and patrol officers Jonathan Casteel and Brandon Mitchell assisted Lt Detective Randall Shuford in serving a search
warrant of Peterson's residence and serve the warrants that had been issued. Peterson is in Yancey County Jail under a $15,000 secure bond
and has a court date of 6/18/2010.
Deyton Arrest
On 5/28/10 Officers from the Burnsville Police Department arrested Jamie Smith Deyton,10/16/79 of 149 Oak Hill Road, Burnsville and charged her
with several drug violations. Deyton was charged with 2 counts of Possession with intent to Sell or Deliver a Counterfeit Controlled Substance,
2 counts of Sell or Deliver a Counterfeit Controlled Substance, Possession with Intent to manufacture, sell or deliver a Schedule IV Controlled
Substance, Sell or Deliver a Schedule IV Controlled Substance and Maintaining a vehicle for the purpose of Selling a Controlled Substance.
Deyton had a bond set of $16,000 and has a June 8 court date.
Officer Makes Drug Arrest from Building Check
On 5/27/10 Officer Jonathan Casteel of the Burnsville Police Department was checking the St. Thomas Church around midnight
and located a suspicious vehicle in the parking area. After speaking with the subjects in the vehicle Officer Casteel found
Kimberly Sutton to be in possession of a controlled substance and drug paraphernalia. Sutton was arrested and charged with
Simple Possession of a Schedule II controlled substance and Possession of Drug Paraphernalia.
